Terms & Conditions
A participant is deemed to have accepted and agreed to be bound by these Terms and Conditions and the decisions of PA. Such individual is responsible for ensuring that he or she has read and understood these Terms and Conditions prior to entering the Event.
1. Participants below 18 years of age are required to seek his or her parent or legal guardian’s permission, and confirm that his or her parent or legal guardian has consented to the terms of this Terms & Conditions on his or her behalf.
2. For purposes of ensuring the safety of all individuals at the Event (including but not limited to the prevention of accidents and adhering to necessary Safe Management Measures), an Participant shall obey the instruction(s) of any Staff. If an Participant fails to obey such instruction(s), he or she shall be removed immediately from the Event in the sole and final discretion of PA.
3. No individual (including without limitation to a Participant) at the Event shall make or exploit any recording, transmission and/or broadcast, whether audio, visual or audio visual, by any means or media whatsoever of the Event (including any activities or performances of the Event) for commercial or for-profit purposes. If any individual at the Event makes such recording, transmission and/or broadcast, or if PA has grounds to suspect that such recording, transmission and/or broadcast is being made, PA may, without compensation or explanation, search, confiscate and/or remove any equipment used or suspected to be used for the making of such recording, transmission and/or broadcast.
4. All individuals (including without limitation to Participants) entering the Event are deemed to consent to being photographed, recorded or videoed by PA and herewith grant PA permission to use and/or broadcast such photographs, records and/or videos for PA’s commercial, publicity and/or promotional purposes (which may include sharing such photographs and/or videos with PA’s commercial, media, advertising and other partners for such purposes).
5. Whilst reasonable precautions will be taken by PA to ensure the Participant’s safety during and at the Event, the Participant takes part in the Event at his or her own risk and shall take reasonable care of himself or herself. To the fullest extent permissible by law, none of PA, its related corporations and associated companies, the employees, officers, third party service provider(s), contractor(s) (and the sub-contractor(s) engaged by such contractor(s)) and agent(s) of PA and its related corporations and associated companies, and Event sponsors or co-sponsors will be responsible or held liable for any injury or death of an Participant howsoever arising from preparation for, attendance at or participation in the Event. The Participant is strongly encouraged to consult his or her medical practitioner prior to an Event Entry Purchase and before the Event.
6. PA reserves the right to stop, cancel, vary, amend, change or postpone the Event without any prior notification. For the avoidance of doubt, PA is not liable to any Participant for any changes to any format, line-up, facility or element of the Event.
7. In participating in the Event, the Participant do so at their own risk, and shall ensure that they are physically and medically able to participate in such activities.
8. To the fullest extent permitted by law, none of PA, its related corporations and associated companies and the employees, officers, third party service providers, contractors and agents shall be responsible or held liable for any loss, damage, injury, cost or expense (including any loss of profit or any special, indirect or consequential loss) however suffered or incurred by or caused to Participant arising out of or in connection with Participant’s access or use of the booking platform and/or Participant’s visit to the Event, whether in an action based on contract, tort or otherwise.
9. Participant agrees to indemnify and hold harmless PA, its related corporations and associated companies and the employees, officers, third party service providers, contractor and agents (collectively, the “Indemnified Parties”) from and against all actions, proceedings, claims, liabilities (whether criminal or civil), cost, expenses, fees and damages suffered and legal fees and costs incurred by any of the Indemnified Parties arising out of or in connection with Participant breach of this Terms and Conditions and/or Participant access or use of the booking platform and/or Participant participating in the Event.
10. All Participants shall be responsible for their personal belongings and/or personal equipment while attending the Event.
11. In participating in the Event, all Participants are required to take care of the premises and not cause any damage to the premises and/or any of the installations.
12. All Participants shall be mindful of other visitors and members of the public within the Event and in the vicinity of the Event venue and shall cooperate with PA staff to ensure a safe environment for all such Participants and members of the public. All Participants shall adhere to all reasonable requests made by PA staff.
13. PA reserves the right to remove from the venues any Participant who are uncooperative, or whose actions and conduct are deemed to be unreasonable and/or detrimental to the enjoyment, well-being and safety of other visitors and members of the public.
14. All Participants shall comply with the People’s Association Act and its regulations, and all rules, orders, directives or codes issued by PA from time to time.
15. PA may, in our sole discretion, update and amend this Terms and Conditions at any time and without liability or prior notice to you. By proceeding with your registration and your attendance to the Event following such update shall constitute your agreement to be bound by the updated terms of this Terms and Conditions.
16. All Participants may not assign or transfer any or part of their rights or obligations under this Terms and Conditions to any party.
17. No failure by PA to enforce any provision in this Terms and Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of this Terms and Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
18. The Contract (Rights of Third Parties) Act (Cap. 53B) shall not under any circumstances apply to this Terms and Conditions and any person who is not a party to this Terms and Conditions shall have no right whatsoever to enforce this Terms and Conditions or any of its terms.
19. If any applicable law or a court of competent jurisdiction holds or declares any provision of this Terms and Conditions to be invalid, illegal or unenforceable (whether in whole or in part), such provision shall be deemed modified to the extent, but only to the extent, of such invalidity, illegality or unenforceability and the remaining provisions of this Terms and Conditions shall not be affected.
20. This Terms and Conditions (including all subsequent additions or amendments) shall be governed by and interpreted in accordance with the laws of Singapore. Any matter or dispute arising out of or in connection with this Terms and Conditions shall be submitted to the exclusive jurisdiction of the Courts of Singapore.
